We the users, and former users, of the internet site located at http://www.paypal.com, owned by eBay, Inc., 2005 E. Hamilton Ave., Ste. 350, 2125 Hamilton Ave., San Jose, CA 95125, USA, petition the worldwide free press to investigate the business practices of the PayPal service to answer the following questions:


  1. Does PayPal do everything within its power to secure users accounts against unauthorized use?

  2. Could and should PayPal add new security features to it's service to protect users accounts against unauthorized use?

  3. How does PayPal's security measures compare to other financial websites?

  4. Since Phishing and spoof sites have been a known problem for 3 years, why has PayPal taken no proactive actions to protect their users against such threats?

  5. Did PayPal's practice of hiding the status bar and address bar for their shopping cart and 'buy it now' buttons contribute to the phishing/spoofing problem? (Hiding the status bar removed the "secure website icon" displayed in the browser making it child's play for anyone to mimic the PayPal website, shopping cart or payment page.)

  6. What valid reason would PayPal have for removing a saftey device from all major browsers? (The address and status bars.)

  7. Does PayPal have an internal department that actively searches for spoofs sites? If so, why are so many sites still up? If not, why not?

  8. Does and/or did, PayPal have security breaches from within the company by employees anytime within the past 4 years? If so, how many and how much money was lost?

  9. Has PayPal reported to police and government authorities (FBI, SEC, etc) breaches in security, both internally and externally?

  10. If PayPal has not reported such breaches and financial losses of users' accounts, are they in violation of state and federal laws to protect the accounts of users of financial transaction institutions?

  11. During the October 2004 "outage" were user accounts (and the database) compromised or affected in any manner?

  12. During the October 2004 "outage" were users and the media told the truth about what caused the outage and what effect it had on users accounts?

  13. Is PayPal in compliance with SEC Rules 17a-3 and 17a-4, spelling out new requirements for transfer agents regarding records of electronic communications and communications with customers concerned security breaches of user accounts and the October outage?

  14. Is PayPal complying with terms of the Class Action Lawsuit Settlement agreement? In specific have they provided written documentation to frozen account holders?

  15. What screening process has been used in the past and is used currently to verify the integrity of employees who have access to users' accounts?

  16. Has PayPal (and now eBay) ever fired any employee for financial misconduct?

  17. Has PayPal (and now eBay) ever filed charges against any employees for any reason, if not, why not?

  18. Has PayPal ever hired employees with criminal backgrounds? (Whether known or not at the time of hiring.)

  19. In the last 12 months, what is the true number of accounts that have been "frozen" by PayPal?

  20. PayPal has a policy where it holds third parties accountable for the misdeeds of others. For Example, Joe pays Bob and then Bob pays Peter. It turns out that Joe used stolen or unauthorized funds to pay Bob, which Bob had no knowledge of. Yet PayPal has taken the funds from Peter. Is this lawful?

  21. In reference to the above case, what is PayPal's lawful responsibility in such situations? Is it lawful to hold third party account holders financially responsible for the misdeeds of someone they have no knowledge of, and no direct transactions with, and why isn't PayPal responsible for these loses?
